1. Scope

The following GTC apply to all orders and bookings made via our online shop on the website https://tripsdrill.de/en. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their trade, business or profession. These GTC also apply to future transactions with entrepreneurs without the need for further reference. If the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby rejected; they shall only become part of the contract if we have expressly agreed to them.

2. Contracting partners, contract conclusion

The usage or purchase contract is concluded with Erlebnispark Tripsdrill GmbH & Co. KG. For vouchers relating to overnight stays, the contractual partner is Tripsdrill Natur-Resort GmbH. By presenting the products on the website www.tripsdrill.de, we make binding offers. You may place our products in the shopping basket without obligation and can correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the ordering process. The binding order is placed when you accept the offer for the goods in the shopping basket by clicking the order button. Immediately after submitting the order, you will receive confirmation in text form, thereby concluding a binding contract.

3. Subject of the contract, redemption of tickets

The subject of the contract is:

  • the purchase of tickets and passes of various categories, which grant access to our adventure park and/or wildlife park, to individual facilities or events.
  • the acquisition of vouchers.
  • the purchase of merchandising articles.

Tickets for our events and date-specific tickets or passes are so-called "timed entry tickets”. This means that you select the desired date of your visit at the time of purchase. The ticket/pass is only valid for the booked period. Up to 48 hours before the chosen visit date (except for events, promotions, partnerships and overnight stays), the visit date can be rebooked in the online shop for a small fee. Expired tickets or passes do not entitle the holder to visit on another day, nor to financial compensation or credit. Valid tickets/passes must be presented at the entrance either in printed form or digitally on a mobile device, such as a smartphone, via QR code. Each ticket or pass entitles the holder to the intended admission and becomes invalid after use. Tickets must not be copied or altered, otherwise they will lose their validity.

4. Delivery conditions

E-tickets or passes are generally sent to you free of charge by email as an e-ticket. For postal delivery, shipping costs will be added to the stated prices. Further information on shipping costs can be found in the respective offers. Otherwise, we only deliver by mail. Self-collection is unfortunately not possible.

5. Payment

The purchase price is due immediately upon placing the order. Payment can be made by credit card, via PayPal, or using SOFORT bank transfer.

6. Right of withdrawal

Consumers as defined by § 13 of the German Civil Code (BGB) are entitled to the statutory right of withdrawal as outlined in the withdrawal policy.

7. Retention of title

The goods remain our property until full payment has been received. For entrepreneurs, the following applies in addition: We retain ownership of the goods until all claims arising from an ongoing business relationship have been fully settled.

8. Warranty and guarantee

Unless expressly agreed otherwise, the statutory liability for defects and the Product Liability Act shall apply. Information about any additional applicable guarantees and their specific conditions can be found with the respective product.

9. Liability

 9.1 We are liable for claims arising from damage caused by us, our legal representatives, or vicarious agents in accordance with statutory provisions.

 9.2 In the event of a breach of essential contractual obligations, the fulfilment of which is a prerequisite for the proper execution of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations), due to slight negligence by us, our legal representatives or vicarious agents, liability is limited to the amount of foreseeable damage typical for the contract at the time it was concluded.

10. Place of performance, choice of law and place of jurisdiction

 10.1 The place of performance is our registered office. The entire legal and contractual relationship between you and us shall be governed exclusively by German law.

 10.2 If, in the event of legal action brought by you against us abroad, the question of our liability is not judged under German law, then solely German law shall apply to the legal consequences, in particular regarding the nature, scope, and amount of customer claims.

 10.3 You may only bring legal action against us at our registered office.

 10.4 For our legal actions against park users, the user’s place of residence shall be decisive, unless a special statutory place of jurisdiction applies (in particular the place where the tort occurred). For legal actions against users or contractual partners of the usage contract who are merchants, legal entities under public or private law, or persons whose residence or usual place of abode is abroad, or whose residence or usual place of abode is unknown at the time the action is filed, the place of jurisdiction shall be our registered office.

 10.5 The above provisions shall not apply if and to the extent that non-negotiable provisions of the European Union or other international provisions applicable to the contract are applicable. 

11. Final provisions
In all other respects, our park regulations and our accommodation terms apply. Should any of the above provisions be or become invalid, the validity of the remaining provisions shall remain unaffected.
